SCALE OF FEES AS ADOPTED AT THE 2011 MID-YEAR GENERAL CONFERENCE OF GHANA BAR ASSOCIATION HELD ON 15TH APRIL 2011 AT THE GHANA SCHOOL OF LAW, ACCRA
***Legal Fees of the Ghana Bar Association are exclusive of the additional statutory VAT (12.5%) & NHIL (2.5%) applicable by law.
A.   Conference Fees / Hourly rates :
Where a Lawyer holds conference with clients whether with or without the clients advisors, takes instructions and offers advice, the conference or hourly rate shall be:
(i) Senior Counsel (10 years and above of call to Ghana Bar): Maximum of the cedi equivalent of US$500.00 per hour
Our hourly rate is the cedi equivalent of US$150.00 in non-complicated matters and rises to the cedi equivalent of US$200.00 per hour and cedi equivalent of US$250.00 per hour in complicated and urgent matters where the hourly rate is applicable under the provisions of the Scale of Fees of the Ghana Bar Association.

(ii) Counsel (5 - 9 years of call to Ghana Bar): Maximum of the cedi equivalent of US$375.00 per hour

(ii) Junior Counsel (under 5 years of call to the Ghana Bar) Maximum of the cedi equivalent of US$250.00 per hour
US$150.00 (maximum)
N. Commercial Agreement:
 
For the preparation of commercial agreements including research, legal opinion, drafting and engrossment or finalisation, but excluding conferences with clients :
(a) the fee shall be the same as hourly rates for conference per each hour spent or : or
(b) the fee shall be based on a percentage of the consideration or the lump sum involved in the agreement as follows:
(i) for agreement where the consideration or the lump sum involved is less than GH¢10,000.00 a fee not exceeding 15% or
(ii) for Agreement where the consideration or the lump sum involved is over GH¢10,000.00 the fee shall not exceed 10%.
(iii) for agreements where the consideration or the lump sum involved is over GH¢50,000.00 and less than GH¢150,000 the fee shall not exceed 7%.
(iv) for agreements where the consideration or the lump sum involved is over GH¢150,000.00 and less than GH¢500,000.00 the fee shall not exceed 5%.
(v) for agreements where the consideration or the lump sum involved is over GH¢500,000.00 the fee shall not exceed 3%.




 



 
CONVEYANCING & DRAFTING
Conveyance & Tenancy
J: Conveyance
The fees for any conveyance shall be based on value of the property being conveyed and shalll not exceed these recommended percentages.
Where the value of property is
(i) up to GH¢20,000.00 - 15% maximum
(ii) over GH¢20,000.00 and up to GH¢100,000.00 - 15% for the first GH¢20,000.00 and balance at 12% maximum
(iii) over GH¢100,000.00 and up to GH¢200,000.00 - 12% for the first GH¢100,000.00 and balance at 10% maximum
(iv) over GH¢200,000.00 and up to GH¢500,000.00 - 10% for the first GH¢200,000.00 and balance at 7.5% maximum
(v) over GH¢500,000.00 - 7.5% for the first GH¢500,000.00 and balance at 5% maximum

K: Tenancy Agreement:
Fee for tenancy agreements shall be based on the yearly rent and other consideration involved.

Where the amount of rent or other consideration involved is :
(i) up to GH¢1 - GH¢20,000.00 - 15% maximum.
(ii) over GH¢20,000.00 and up to GH¢50,000.00 - GH¢3,000.00 plus 10% maximum.
(iii) over GH¢50,000.00 and up to GH¢100,000.00- GH¢3,000.00 plus 7% maximum.
(iv) over GH¢35,000.00 and up to GH¢50,000.00- GH¢3,000.00 plus 5% maximum.
(v) over ¢GH50,000.00- 3% maximum.
R. Debt Collection:
Debt collection as its name implies, involves the recovery of monies such as rent, contract payments and other debts for and on behalf of clients. This may be achieved in two main ways.
(a) by correspondence 
(b) by instituting legal action for the recovery of the debt or acting on behalf of the debtor in any such action.
All expenses for the recovery of debts should be borne by the client.
a) Debt Collection by Correspondence :
(i) Where the amount involved is up and includes,
(a) GH¢25,000.00  - 10% maximum
(b) GH¢100,000.00 - 10% for first GH¢25,000.00 and balance at 7% maximum
(c) GH¢400,000.00 - 10% for first GH¢25,000.00 and balance up to GH¢100,000.00 at 7% and remaining balance at   
                                5% maximum
(c) over GH¢400,000.00 - 10% for first GH¢25,000.00 and balance up to GH¢100,000.00 at 7%, balance up to GH400,000.00 at
                                  5% and remaining balance at 3% maximum

(b) debt collection by instituting legal action :
Fees are provided for under brief fees ( See clause E(k) supra.

BUSINESS ENTITY INCORPORATION
Incorporation of Corporate Body

  1. Incorporation of Partnership :
The cedi equivalent of a fee range between US$500.00 - US$2,500.00 shall be charged for the incorporation of a partnership and the drafting of the partnership agreement shall attract an additional fee range between US$1,000.00 - US$2,000.00 ( cedi equivalent). Hours rates would apply if the man hours exceed US$2,500.00

  1. Company Registration :
A fee range between US$1,000.00 - US$ 4,000.00 (cedi equivalent) shall be charged for the incorporation of a company. A separate fee ranging between US$1,000.00 - US$ 2,000.00 shall be charged for the preparation of the Articles of Incorporation or Regulations of the Company. Hours rates would apply if the man hours involved exceed US$2,000.00
DEBT COLLECTION
SUCCESSION, ESTATE & PROBATE MATTERS
O.  Wills :
(i) Simple Wills (without any Trust or limitation or dispositions - GH¢1000.00 maximum or hourly rate would apply if the hours exceed GH1,000.00
(ii) Complicated Wills -GH¢3,000.00 maximum, or hourly rates would apply if the hours exceed
GH¢3,000.00
 
P. Probate & Letters of Administration (Non-Contentious)
Value of Estate Fees to be charged
(a) Up to GH¢100,000.00 ¢50.00. GH5,000.00 maximum
(b) over GH¢100,000.00 GH5,000.00 for the first 100,000.00 plus up to 5% for any additional value.

The preparation of Vesting Assents and the Winding up of estates should not be included as part of the matters relating to Probate and Letters of Administration and must be treated as separate matters. The fees to be charged for vesting Vesting Assent and Winding Up of an Estate shall be the same as the scale for Probate and Letters of Administration specified above provided that where teh same Lawyer was responsible for the Probate and Letters of Administration, the maximum fee for the Vesting Assent and Winding Up of an Estate shall not exceed 50% percent of the fees approved.

A. Initial Consultation fees

C. Retainer Fees
The minimum rate for retainer shall be GH¢1,000.00 per month with the proviso that the client shal be entitled to free consultation in addition to a discount of 20-30% on rates for the various items listed in this Scale.
 
 
  1. Circuit & High Court Brief Fees:
The following brief fees shall be charged for cases falling under these headings:
a) Land Litigation - 10%-20% of the value of the land or hourly rates would apply if the legal work involved exceeds the 20% value of the land
b) Labour Litigation - 10%-20% of the total claim or hourly rates would apply if the hourly rates involved exceeds 20% of the claim
c) Human Rights Litigation - GH¢2,000.00-GH10,000.00 or hourly rates would apply if the hourly rates involved exceeds
GH¢10,000.00
d) Estate Litigation - 5%-20% of the total value of estate or hourly rates would apply if the hourly rates involved exceeds 20% of the estate
e) Maritme Litigation - cedi equivalent of US$20,000.00 - US$50,000 or hourly rates would apply if the hourly rates involved exceeds US$50,000.00
f) Aviation Litigation - cedi equivalent of US$20,000.00 - US$50,000 or hourly rates would apply if the hourly rates involved exceeds US$50,000.00
g) Libel Litigation - GH¢5,000.00 - GH¢10,000.00 or hourly rates would apply if the hourly rates involved exceeds GH¢10,000.00
h) Landlord and Tenant Litigation - 5%-15% of subject matter or hourly rates would apply if the hourly rates involved exceeds 15% of the claim
i) Labour Litigation - 10%-20% of the total claim or hourly rates would apply if the hourly rates involved exceeds 20% of the claim
g) Matrimonial Litigation - Dissolution & Custody only - - GH¢5,000.00 - GH¢15,000.00 or hourly rates would apply if the hourly rates involved exceeds GH¢15,000.00

  1. Brief Fees for District Courts
Brief fees at the District Court should not exceed 50% of the brief fees charged in the High Court and Circuit Court.
  1. Brief Fees for Appeals
Civil Appeals

High Court - 15% of value of subject-matter or if no value GH¢15,000.00 -

Court of Appeal - 15% of value of subject-matter or if no value GH¢20,000.00 -

General & Other matters:
  1. Refresher Fees
Where litigation stretches over an unreasonably long period, there shall be renegotiation on refresher fees after every two years; provided that the delay shall not be traced to the default or inaction of the lawyer.

  1. Out of pockets Expenses:
This includes the costs of incidentals and out-of-pocket expenses such as filing fees, stamping of documents, swearing of affidavits, services of processes, telephone, fax, e-mail, photocopying, postage, transportation to render services for and on behalf of the client, preparation of appeal records, execution of judgment and notarization among other incurred on behalf of the client. These shall be billed separately and paid by the client

Seniority at the Bar :
A senior is a person who has attained ten (10) years post call practice as a Lawyer.

Value Added Tax:
All Legal Fees are exclusive of VAT & NHIL. The rate of the VAT tax currently is 12.5% of fees charged and the NHIL is 2.5% of fees charged.
  1. Legal Opinion & Specialised Services:


a) Power of Attorney - Fee for two (2) hours maximum or hourly rates would apply if the hours involved exceed two hours

b) Statutory Declaration - Two (2) hours maximum or hourly rates would apply if the hours involved exceeds two hours

c) Notary Fees - Two (2) hours maximum or hourly rates would apply if the hours involved exceed two hours

d) Legal Opinion in Writing
Intra- Country - minimum rate of GH¢3,000.00
Cross Border - minimum rate of US$5,000.00 ( cedi equivalent)
